Terms and Conditions

By accessing, browsing, registering an account on, or otherwise using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy and Refund Policy, which are incorporated here by reference. If you do not agree to any part of these Terms, you must not use the Platform.

Account creation on the Platform requires you to affirmatively accept these Terms and the Privacy Policy via a checkbox at the time of registration. That acceptance is recorded with a timestamp and constitutes your electronic signature.

This Section is fundamental to your use of the Platform. You must read it carefully before creating an account or making any purchase.

Everything issued through the Platform, including without limitation any item referred to as a "Mars land plot", "plot", "parcel", "certificate", "digital certificate", "badge", "ownership record", "title", or by any similar name (each a "Digital Certificate"), is a digital certificate of nobility and novelty digital asset. Digital Certificates are created and issued solely for personal enjoyment, entertainment, collection, and community membership purposes.

You expressly acknowledge and agree that Digital Certificates:

• are NOT real property and do not represent, evidence, or confer any real property interest of any kind;
• are NOT a deed, title, or registration of any land, plot, territory, or real estate anywhere in the physical universe, including on Earth, Mars, or any other celestial body;
• are NOT a company registration, business entity, incorporation, charter, license, or legal registration of any kind on Mars, in any jurisdiction on Earth, or anywhere else;
• confer no legal, property, ownership, tenancy, mining, exploration, broadcasting, occupancy, governance, voting, dividend, or economic rights whatsoever.

No individual, company, government, or other entity can hold or grant legal title to land or resources on Mars or any other celestial body under applicable international law, including the Treaty on Principles Governing the Activities of States in the Exploration and Use of Outer Space of 1967 (the "Outer Space Treaty"). MarsColonia makes no claim, representation, or warranty to the contrary. Any language used on the Platform (such as "own", "buy", "sell", "rent", "plot", or "territory") is thematic and refers strictly to the novelty digital asset, not to any real world right.

You further acknowledge and agree that no User may make any legal claim, demand, complaint, lawsuit, arbitration, chargeback, regulatory filing, or ownership assertion of any kind against MarsColonia, its affiliates, officers, employees, contractors, partners, service providers, or any third party on the basis of holding, having held, or having transacted in a Digital Certificate, under any circumstances.

By creating an account, you explicitly acknowledge and confirm that you have read, understood, and agree to this Section 2, and that you are not relying on any representation, promise, or expectation that Digital Certificates constitute real property, real estate, land title, business registration, financial instruments, or anything other than a novelty digital collectible.

MarsColonia does not offer, provide, market, or hold itself out as providing any investment advice, financial advice, tax advice, legal advice, brokerage, dealing, portfolio management, financial planning, or financial consultancy services of any kind. Nothing on the Platform constitutes an offer, solicitation, or recommendation to buy, sell, or hold any security, commodity, derivative, virtual asset, or other financial instrument.

The Platform, the Company, and https://marscolonia.com/ must never be represented, marketed, interpreted, or relied upon as an investment vehicle, security, financial product, savings scheme, yield product, or collective investment scheme of any kind. Any thematic references on the Platform to "yield", "value", "returns", "marketplace", or similar terms are descriptive of a novelty platform experience only.

Any decision to acquire, dispose of, rent, list, or otherwise transact in a Digital Certificate is made entirely at your own risk, at your own sole discretion, and at your own sole liability. MarsColonia and its affiliates are not responsible or liable, under any circumstances, for any financial loss, opportunity cost, taxation exposure, disappointment, emotional distress, or claim of any kind arising from or connected with your decision to buy, sell, rent, hold, or transact any Digital Certificate or Platform feature.

You are strongly encouraged to seek independent professional advice from qualified advisors before making any decisions with financial implications. You must not treat any Platform content, communication, email, notification, or design element as financial, investment, tax, or legal guidance.

"Bonus Funds" means any credit, balance, reward, promotional grant, referral reward, campaign reward, welcome grant, or similar in-platform value granted or credited to your account, however described on the Platform.

Bonus Funds may be used solely within the Platform, for Platform-native purposes such as offsetting the price of a Digital Certificate, and for no other purpose. Bonus Funds have no cash value outside the Platform.

Bonus Funds and any similar in-platform balances cannot be withdrawn, cashed out, redeemed for real currency, transferred to any bank account, card, payment account, wallet, or third party, or converted to real world money under any circumstances, regardless of how they were earned (referral reward, campaign reward, promotion, goodwill credit, or otherwise).

Any request, attempt, workaround, or demand to withdraw, transfer, cash out, sell, gift, or convert Bonus Funds to real money, or to move Bonus Funds off the Platform, is strictly and expressly prohibited and constitutes a material violation of these Terms. MarsColonia may, in its sole discretion and without prior notice, suspend or terminate any account that engages in such conduct, and may revoke any Bonus Funds, referral rewards, or other benefits associated with the account.

Bonus Funds may expire, may be adjusted for fraud prevention, and may be modified or discontinued at any time. MarsColonia's determination as to the availability, validity, and use of Bonus Funds is final.

You must be at least the age of majority in your jurisdiction (and in any event at least 18 years old) to create an account. By registering, you represent that the information you provide is true, accurate, current, and complete, and that you will keep it updated.

Each person may hold one account. You are responsible for all activity that occurs under your account, including for keeping your credentials confidential. You must notify us promptly at team@marscolonia.com if you suspect unauthorized use of your account.

The Platform may offer a referral program that rewards Users for introducing new, genuinely independent, verified Users to the Platform. Rewards are credited as Bonus Funds and are subject to Section 4.

Only genuine referrals of new, distinct, verified Users are eligible. Self referrals, duplicate accounts, coordinated referral rings, use of automated tools, incentivized fake signups, and any other manipulation are prohibited and may result in reward reversal, account suspension, or termination. MarsColonia's determination on referral validity is final.

You agree not to:

• use the Platform for any unlawful, fraudulent, deceptive, or abusive purpose;
• attempt to withdraw, transfer, or convert Bonus Funds contrary to Section 4;
• manipulate the referral, reward, or pricing systems, including through fake accounts, bots, or coordinated activity;
• harass, threaten, or defame other Users, our staff, or third parties;
• probe, scan, or test the vulnerability of the Platform or breach any security or authentication measure;
• misrepresent Digital Certificates as real property, financial instruments, registered businesses, or securities to any person.

MarsColonia and its licensors own all right, title, and interest in and to the Platform, including all software, text, graphics, logos, marks, artwork, Digital Certificate designs, templates, and other content (the "Platform Content"). Users are granted a limited, personal, non exclusive, non transferable, revocable license to access and use the Platform Content solely for personal, non commercial use in connection with the Platform.

Nothing in these Terms transfers any intellectual property rights to you. All rights not expressly granted are reserved.

The Platform, all Digital Certificates, and all related features are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non infringement, accuracy, uninterrupted service, or any warranty as to the current or future value (real, perceived, monetary, artistic, or otherwise) of any Digital Certificate or Bonus Funds.

To the maximum extent permitted by applicable law, MarsColonia and its affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to the Platform, the Digital Certificates, the Bonus Funds, or these Terms, whether based on contract, tort, negligence, strict liability, or any other legal theory, even if MarsColonia has been advised of the possibility of such damages.

To the maximum extent permitted by applicable law, MarsColonia's aggregate liability arising out of or related to the Platform or these Terms shall not exceed the greater of (a) the total amount you actually paid to MarsColonia in the three months preceding the event giving rise to the claim, or (b) fifty United States dollars (USD 50).

You agree to defend, indemnify, and hold harmless MarsColonia and its affiliates, officers, employees, contractors, partners, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your misrepresentation of any Digital Certificate as real property, financial instrument, security, or registered business.

MarsColonia may suspend or terminate your account and access to the Platform at any time, with or without notice, for any reason, including for any violation of these Terms, any suspected fraud, or any abuse of Bonus Funds or the referral program.

Upon termination for cause, any Bonus Funds, pending referral rewards, and unclaimed benefits associated with the account are forfeited. Sections that by their nature should survive termination (including Sections 2, 3, 4, 8, 9, 10, 11, and 15) will survive.

We may update these Terms from time to time. If we make material changes, we will notify Users by email or by posting a prominent notice on the Platform, and we will update the "Last Updated" date at the top of this page. Your continued use of the Platform after the effective date of the updated Terms constitutes your acceptance of the changes.

These Terms, together with the Privacy Policy and the Refund Policy, constitute the entire agreement between you and MarsColonia regarding your use of the Platform, and supersede any prior agreements. If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision will not be a waiver of that right or provision.
